You affirm that you are either more than 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. You agree to be bound by the terms of service of media or platforms by connecting your platform accounts to the Streamster Service.

By registering for, accessing, browsing, downloading from or using the Streamster service, you acknowledge that you have read, understood, and agree to be bound by these terms of service. If at any time you do not agree to these terms of service, please immediately terminate your use of the Streamster service or contact us at [email protected] to discuss any concerns you may have regarding these terms of service.

By using or opening an account with Streamster, you acknowledge and agree for the service to perform actions (such as, but not limited to: “connecting”, “subscribing”, “following”, or “liking”) on your behalf only to or on the official Streamster account(s) on the platform(s) you explicitly connect.

Modification of these Terms of Use

Streamster reserves the right, at our discretion, to change, modify, add, or remove portions of these Terms of Use at any time (for example to reflect updates to the Streamster Service or to reflect changes in the law). If Streamster changes these Terms of Use, we will provide you notice of these changes, such as by sending an email, posting a notice on the Streamster Service. Please check these Terms of Use and any Guidelines periodically for those changes. Your continued use of the Streamster Service after the posting of changes constitutes your binding acceptance of such changes. For any material changes to these Terms of Service, the amended terms will automatically be effective thirty days after they are initially posted on the Streamster Service unless you contact us to discuss any questions or comments during that time period. We will always make a reasonable effort to notify you if we do change these Terms of Use.

Streamers Content Representations and Warranties

You are solely responsible for your Broadcaster Content and the consequences of posting or publishing it. By uploading and publishing your Broadcaster Content, you represent, and warrant that: (1) you are the creator and owner of the Broadcaster Content or otherwise have sufficient rights and authority to grant the rights granted herein; (2) your Broadcaster Content does not and will not (a) infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right or (b) slander, defame, or libel any other person; (3) your Broadcaster Content does not contain any viruses, adware, spyware, worms, or other harmful or malicious code or (4) unless you have received prior written authorization, your Broadcaster Content specifically does not contain any prerelease or non-public beta software or game content or any confidential information of Streamster or third parties. Streamster reserves all rights and remedies against any Broadcasters who breach these representations and warranties. Content is Uploaded at Your Own Risk.

YOU AGREE NOT TO:

use the Service for any illegal purpose or in violation of any local, state, national, or international law;
upload, post, or distribute any User Forum Content or other content on the Service that is unlawful, defamatory, libelous, or that a reasonable person could deem to be profane, indecent, harassing, threatening, embarrassing, hateful, or otherwise inappropriate;
violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right;
interfere with security-related features of the Service, including by (a) disabling or circumventing features that prevent or limit access, or (b) reverse engineering or otherwise attempting to discover the source code of any portion of the Service except to the extent that the activity is expressly permitted by applicable law;
interfere with the operation of or any user’s enjoyment of the Service, including by: (a) uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code; (b) making any unsolicited offer or advertisement to another user; (c) attempting to collect personal information about another user or third party without consent; or (d) interfering with or disrupting any network, equipment, or server connected to or used to provide the Service;
perform any fraudulent activity including impersonating any person or entity, claiming a false affiliation, or accessing any other user’s Service account without permission;

Streamster uses reasonable security measures in order to attempt to protect Broadcaster Content. Streamster doesn’t resell or provide backdoor access to the video content or any user information to third parties.

Termination

Streamster reserves the right, without notice and in our sole discretion, to terminate your license to use the Streamster Service (including to post Broadcaster Content), and to block or prevent your future access to and use of the Streamster Service. Your only remedy with respect to any dissatisfaction with (1) the Streamster Service, (2) any term of these Terms of Service, (3) any policy or practice of Streamster in operating the Service, or (4) any content or information transmitted through the Streamster Service, is to terminate your account and discontinuing use of any and all parts of the Streamster Service. In serious cases of breach of these Terms of Service (for example, infringement of Streamster ’s intellectual property rights or actions causing it financial loss), Streamster may consider it appropriate to take legal action against you (though we will try to resolve matters amicably with you if possible).

Warranty Disclaimer

You agree that your use of the Streamster service shall be at your sole risk. To the fullest extent permitted by law, Streamster, its owners and/or employees disclaim all warranties, express or implied, in connection with the website and your use thereof. Streamster makes no warranties or representations about the accuracy or completeness of this site’s content or the content of any sites linked to this site and assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website, (3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from our website, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our website by any third party, and/or (6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Streamster services. Streamster does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Streamster services or any hyperlinked website or featured in any banner or other advertising, and Streamster will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. as with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

Limitation of Liability

In no event shall Streamster , its owners and/or employees be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (1) errors, mistakes, or inaccuracies of content, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of Streamster service, (3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from Streamster service, (5) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our website by any third party, and/or (6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Streamster , whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. the foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. you specifically acknowledge that Streamster shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

Subscribers and Payment

Service Plans. Our service plans and the associated fees are set forth at streamster.io/pricing (“Pricing Plans”). Some features of the Service such as the virtual computing environments are accessible only to users who select one of our Service Plans and pay the fees associated with such Service Plan to Streamster (each such user, during the period of time for which they have paid such fees, a “Subscriber”).

Fees and Payment. By using the Subscriber dashboard to purchase computing time, you authorize Streamster to charge the associated fees for such purchase to the payment method you specify at the time of purchase. If you pay any fees with a credit card, Streamster may seek pre-authorization of your credit card account prior to your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover your purchase. All fees are in United States dollars.

Streamster does not accept payments through public proxies, Tor or other anonymizing services.

Acknowledgement of third party terms

By utilizing Streamster to engage with YouTube, users hereby acknowledge and agree that they are bound by YouTube’s Terms of Service. Your access to and use of YouTube is conditioned upon your compliance with YouTube’s terms of service.

Third Party Fees

When using the Service, you may transmit and receive large quantities of data. Any fees charged to you by your internet service provider, mobile carrier, or other third party service provider are your sole responsibility, even if such fees are for services (such as data transmission) that you use in connection with the Service.
